Terms of Use

These Terms of Use (“Terms”) govern your use of the PixDevs games, apps, and this website (together, the “Services”), provided by Fredrick Thorsen, operating as PixDevs (“PixDevs”, “we”, “us”). By downloading, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 13 years old, or the minimum digital-consent age in your country, to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or guardian, who agrees to these Terms on your behalf.

Subject to these Terms, PixDevs grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to download and use the apps on a device you own or control, for your personal, non-commercial entertainment. We reserve all rights not expressly granted.

The Services and all of their content — including the games, artwork, audio, characters, text, code, and the PixDevs name and logo — are owned by PixDevs (Fredrick Thorsen) or its licensors and are protected by intellectual-property laws. Except for the licence above, these Terms grant you no right, title, or interest in the Services. You may not use our trademarks without our prior written permission.

Our games are free to download and play, and are supported by advertising. We use Google AdMob to show ads; how ad-related data is handled, and the consent choices available to you, are described in our Privacy Policy. Our games contain no in-app purchases, subscriptions, or virtual currency, and we never ask you to pay to play. If we introduce paid features in the future, we will update these Terms and the Privacy Policy before they become available.

You agree not to:

• reverse-engineer, decompile, or attempt to extract the source code of the apps, except where this restriction is prohibited by law;
• cheat, exploit bugs, use unauthorised third-party software, or otherwise tamper with the Services;
• use the Services unlawfully or to infringe others' rights; or
• interfere with the operation of the Services or other players' enjoyment of them.

The Services rely on third parties — including the Apple App Store and Google Play, and our advertising provider, Google AdMob. These parties operate under their own terms and privacy policies, and PixDevs is not responsible for them. The advertising shown in our games is also subject to the consent choices described in our Privacy Policy.

The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

To the maximum extent permitted by law, PixDevs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your mandatory consumer rights.

To the extent permitted by law, you agree to indemnify and hold harmless PixDevs from any claims, damages, or expenses arising out of your misuse of the Services or your breach of these Terms.

We may suspend or terminate your licence to use the Services if you breach these Terms or to protect the Services. You may end these Terms at any time by ceasing to use the Services and deleting the apps. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and governing law — survive termination.

We may update the Services or these Terms from time to time. When we change these Terms, we will revise the “last updated” date, and your continued use of the Services after the change takes effect means you accept the revised Terms. We may also modify, suspend, or discontinue features of the Services.

These Terms are governed by the laws of Norway, without regard to conflict-of-laws rules, and the courts of Norway will have jurisdiction. If you are a consumer in the EEA or elsewhere, this does not deprive you of the protection of the mandatory consumer-protection provisions of the law of your country of residence, which are expressly preserved.

The following applies if you obtained an app from the Apple App Store. You acknowledge that:

• these Terms are concluded between you and PixDevs only, and not with Apple; Apple is not responsible for the app or its content;
• Apple has no obligation to furnish any maintenance or support services for the app;
• in the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app;
• PixDevs, not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or similar law;
• PixDevs, not Apple, is responsible for investigating and resolving any third-party claim that the app or your use of it infringes that party's intellectual-property rights;
• you represent that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you; and
• for any questions, complaints, or claims regarding the app, you may contact PixDevs at support@pixdevs.com.

If you obtained an app from Google Play, your use is also subject to the Google Play Terms of Service. PixDevs, not Google, is responsible for the app and its content.
